DMCA Copyright Policy

Copyright Compliance

KDAssist respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid notices of copyright infringement.

User Responsibility

Users are responsible for ensuring they have the right to upload content to KDAssist. While we do not actively monitor uploads, we will respond to valid copyright complaints.

If you receive a notice that your profile picture was removed due to a copyright complaint, you may upload a different image.

DMCA Takedown Procedure

If you believe that content on KDAssist infringes your copyright, submit a written notice to our designated DMCA agent with the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or if multiple works, a representative list of such works
  2. Identification of the infringing material and information reasonably sufficient to permit us to locate it (specific URL or user profile link)
  3. Your contact information including name, address, telephone number, and email address
  4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

Response to Valid Notices

Upon receipt of a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who uploaded the content
  3. Terminate repeat infringers' accounts

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification with:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if outside the United States), and that you will accept service of process from the complainant

Processing Time

We will process valid DMCA notices and counter-notifications within 10 business days of receipt.

Repeat Infringer Policy

Users who repeatedly upload infringing content will have their accounts permanently terminated.

False Claims

Submitting false or fraudulent DMCA notices may result in legal liability under Section 512(f) of the DMCA.
